What is agreed when you order
These terms govern every order placed through this site. They are written to be read; where a clause has a legal consequence that is easy to misread, it is restated underneath in ordinary language.
Who you are contracting with
The seller is Luca-Max Liebenberg, Wahlstedt, Germany, selling privately. Full provider details are on the imprint. There is no commercial register entry.
When the contract is formed
Placing an order is an offer to buy. The contract comes into existence when NOCTIS confirms the order by email, which is normally within one working day. The automatic acknowledgement shown on screen immediately after checkout is a receipt, not an acceptance.
NOCTIS may decline an order — for instance where a batch has sold out between the order and the confirmation. Where that happens, any authorised amount is released in full and nothing is captured.
In plain terms: Placing an order is an offer. The contract exists once we confirm it by email.
Prices and value added tax
All prices are in euro. Under section 19 of the German VAT Act no value added tax is charged, and none is stated -- not in the cart, not at checkout and not on the invoice.
Orders shipped outside the European Union may attract import duty or tax in the destination country, payable by the recipient.
In plain terms: The price you see is the price you pay. No value added tax is charged.
Payment
Card payments are authorised when the order is placed and captured when the batch is filled, which may be several weeks later. Where an authorisation expires before filling, NOCTIS will request a new one before dispatch. SEPA transfers must clear before composition begins. Invoices are payable thirty days from dispatch.
Card details are handled by the payment provider. NOCTIS receives an authorisation reference and never receives, stores or processes a card number.
Delivery
Bottles are filled to order from the current batch and dispatched within five working days unless the product page states a longer lead time. Transit within Germany is normally one to two working days, within the European Union two to five.
Fragrance is shipped as a limited quantity of dangerous goods under ADR. It cannot be sent by air freight, to a packing station, to a post box or to an address outside the carrier’s ground network. A street address capable of accepting a signed-for parcel is required.
Risk passes to a consumer on delivery, not on dispatch.
In plain terms: Five working days to fill, then two to five in transit. Street addresses only.
Right of withdrawal
A consumer may withdraw from a distance contract within fourteen days of receiving the goods, without giving a reason, by an unambiguous statement sent to l.liebenberg@opti-rail.de. Return postage is at the customer’s expense; the purchase price and standard outbound delivery are refunded within fourteen days of the withdrawal reaching us.
The right of withdrawal does not apply to sealed goods which are not suitable for return for reasons of health protection or hygiene once they have been unsealed. Fragrance falls within this exception. A flacon whose seal has been broken cannot be returned, and a flacon returned unsealed will be sent back.
In plain terms: Fourteen days to change your mind — but only on unopened bottles. Once the seal is broken it cannot be returned.
Defects
The statutory warranty applies: two years from delivery for a defect that was present at the time of delivery. A leaking atomiser, a cracked flacon or a batch that does not match its formula is a defect and is replaced or refunded at the customer’s choice.
Natural materials vary between harvests, and a fragrance may differ perceptibly between batches. Where such a difference exceeds what the formula tolerates it is treated as a defect; where it does not, it is a property of the product and the batch record shows why.
Accounts and invitations
Accounts are opened by invitation. An invitation code is personal to the person it was issued to, is valid for twelve months, and opens a fixed number of accounts. NOCTIS may close an account that is used to resell product commercially, and will fulfil any order already confirmed on it.
Applicable law and disputes
German law applies, without prejudice to the mandatory consumer protections of the country in which the consumer is habitually resident. A consumer may bring proceedings in their own country of residence.
The European Commission maintains an online dispute resolution platform at ec.europa.eu/consumers/odr. NOCTIS is not obliged and is not willing to take part in dispute resolution proceedings before a consumer arbitration board.
